Accused murderer will now face death penalty in federal court.
The US Supreme Court has denied Gov. Lincoln Chafee's bid to appeal the court ruling placing accused murderer Jason Pleau in federal custody. The decision was announced in a release this morning from United States Attorney Peter F. Neronha. "I am obviously pleased with the decision of the United States Supreme Court not to review the First Circuit’s entirely correct ruling requiring the State of Rhode Island to surrender custody of Mr. Pleau to the United States for trial in federal court. Lawyers for accused murderer Jason Pleau are asking US District Court Judge William Smith to dismiss elements of the indictment against him to eliminate the possibility of a death sentence. Pleau has been the subject of a struggle between federal authorities and Gov. Lincoln Chafee for nearly a year because he could face the death penalty in federal court. He is charged with the murder of David Main during a night deposit robbery at Citizen's Bank in 2010. In August, Gov. Lincoln Chafee asked the Supreme Court to review the May court decision ordering the state to turn Pleau over to federal custody. The federal government announced today it will seek the death penalty against Jason W. Pleau, charged with murder in Woonsocket last year.
The federal government intends to seek the death penalty against Jason W. Pleau, accused of armed robbery and murder in Woonsocket last year. Pleau was one of three suspects indicted in the murder and robbery of David Main in front of Citizens Bank in Woonsocket last September. Main was shot at close range while attempting to make a deposit of more than $12,000 from the Shell gas station where he worked. The federal government campained to handle the prosecution, which Gov. Lincoln Chafee resisted. But U.S. District Court Judge William Smith ordered Chafee to hand Pleau over to the feds. Rep. Doreen Costa (R- Dist. 31, Exeter, North Kingstown) has drafted a resolution asking Governor Lincoln Chafee to abandon his fight to keep accused murderer Jason Pleau in state custody. Pleau has been the subject of a struggle between federal authorities and Chafee for nearly a year because he could face the death penalty in federal court. On May 10, Chafee said he intends to appeal the U.S First Circuit Court of Appeals ruling telling him to turn over Pleau to federal authorities. This morning, Gov. Lincoln Chafee responded to Deborah Smith, sister to David Main, who says he's preventing just prosecution of Jason Pleau, accused of killing her brother in a 2010 robbery. The RI Senate approved a bill Tuesday sponsored by Sen. Roger A. Picard (D-Woonsocket, Cumberland) requiring security cameras at bank night deposit boxes. According to a release from the senator's office, bill 2012-S 2072 would require all financial institutions and credit unions in the state to install and maintain cameras that record their night deposit areas. “This is a relatively simple measure that can be taken to help protect people who have to make after-hours deposits,” said Picard, “Those boxes are frequently used by managers of businesses who have to make large deposits, and any banks that haven’t already placed security cameras there to help protect them should do so.” The need for the law was brought to Picard’s attention …
